Temporary Market, Fair & Car Boot Sale Consent

  1. Wigan Council is the responsible body for the management of market rights within the borough of Wigan. Prior consent must be sought from Wigan Council to hold any temporary market, fair or car boot sale within 6 2/3 miles of a market currently operating within the borough of Wigan.
  2. The Organiser of any market, fair or car boot sale held within the borough must apply for consent using the Application to Hold a Temporary Market / Car Boot Sale.
  3. Applications must be made at least 28 days prior to the date of sale.
  4. Goods sold at car boot sales may only be second hand, the sale of new goods is prohibited.
  5. The organiser of any market, fair or car boot sale assumes full responsibility for the operation of the event including: Regulatory and legislative requirements Planning consent and Licensing Health and safety Events notices and closures Insurance and risk management.;
  6. Wigan Council accepts no responsibility or liability for markets, fairs and car boot sales held within the borough of Wigan where consent has been granted. The granting of consent is not an endorsement of the event by Wigan Council.
  7. Charitable, social, religious, sporting, and other non-profit making organisations will be permitted to hold up to two sales in any financial year without having to pay to Wigan Council any fee. The financial year runs from 1 April to 31 March.
  8. The fee described below will be charged in respect of any further events held by or for the same organisation and will be charged accordingly.
      • The Administrative Fee Charitable, social, religious, sporting, and other non-profit making organisations will receive two free events per financial year
      • Further events will be charged at £10 per event, plus £1 per vehicle thereafter
      • All other organisations are charged £10 per event plus £1 per car/stall
      • All organisations are restricted to 14 events per financial year
      • A maximum of 14 events per financial year may be held on any one piece of land.
  9. The organisers shall not cause or permit notices or posters advertising the event to be displayed on lamp posts, buildings and alike without the permission of the owner or in contravention of the Town and Country Planning Act 1990 (Advertisements without permission).
  10. All advertising matters relating to an approved event must include the statement, “Wigan Council has consented to the holding of this Temporary Market / Fair / Car Boot Sale”.
  11. Wigan Council reserves the right to refuse consent to hold an event if it is deemed to have a detrimental affect on its own markets.
  12. Wigan Council Officers may perform spot checks.
