Introduction

Our core data protection obligations and commitments are set out in the  Wigan Council Primary Privacy Notice.

This notice provides additional privacy information for Planning and Transport Policy, Regeneration, Major Projects and Commercial Developments.

What personal data do we collect?

To carry out activities and obligations we process the following personal data:

  • Name
  • Address
  • Telephone number
  • Email address
  • Date of birth
  • Gender
  • Bank account details. 

We also process the following Special Category Data:

  • Information about any disability you may have (i.e. health data), your race or ethnicity, religious beliefs, sexual orientation.

How we use personal data

The main purposes for processing your personal data are:

  • Inclusion on mailing lists for project updates
  • Involvement in consultations and stakeholder events
  • Processing, reporting on, and responding to feedback received during consultations
  • To consider applications for grant or project support
  • Establishment and maintenance of contracts
  • Dealing with enquiries
  • Dealing with complaints
  • Inclusion on the custom and self-build register.

Legal Basis for processing

The lawful bases we rely on for processing your personal data are:

  • It is necessary for compliance with a legal obligation
  • It is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller
  • It is necessary for the performance of a contract
  • You have given consent to the processing of your personal data for one or more specific purposes.

The legal obligations arise from the following (non-exhaustive) list:

  • Town and Country Planning Act 1990 as amended
  • Transport Act 2000 as amended
  • Levelling Up and Regeneration Act 2023
  • Self-build and Custom Housebuilding Act 2015.

Who do we share personal data with?

In addition to the general reasons for data sharing described in the Council’s Primary Privacy Notice, we collect from or share personal data with the following when required:

  • Other teams within Wigan Council
  • Other local authorities
  • GMCA and TfGM
  • Government departments and agencies including, but not limited to, Homes England and Ministry of Housing, Communities and Local Government
  • Independent Planning Inspector
  • Utility Companies
  • Developers, Professional Consultants and Contractors. 

Where you have contributed to a statutory consultation on a local plan or development plan, your comments (along with your name and organisation) may be published online, but no further personal details will be published. Following a statutory formal consultation stage, your comments and full contract details will be provided to the Planning Inspector appointed to undertake the public examination of the plan. 

How long do we keep personal data?

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any future legal, accounting, or reporting requirements.

We must continue to retain necessary data in accordance with our corporate records policy to fulfil legal, statutory and regulatory requirements.

All the decisions we make about you involve human intervention.
