Introduction

Our core data protection obligations and commitments are set out in Wigan Council Primary Privacy Notice.

This notice provides additional privacy information for applicants and service users of the Integrated Transport Unit and contracted drivers.

What personal data do we collect?

To carry out activities and obligations as a Transport service we process the following personal data:

  • Personal and contact details such as title, full name, address, telephone numbers, email addresses
  • Personal demographics including date of birth, age, gender, marital or civil partnership status
  • Details about family members (e.g. other children or family members in your household; or other relatives connected with the care of the service-user)
  • Financial information relevant to assessing eligibility
  • Names of schools / education establishments; school year group
  • Name of day centre establishments attended.

 We also process the following Special Category Data:

  • Health, medical conditions or mobility and support needs
  • Details of needs and abilities of service-users including emotional, social and behavioural; learning difficulties, physical disabilities or impairments
  • Information contained in an Education, Health and Care plan (EHC plan).

We also process the following Criminal Offence Data:

  • Offences (including alleged offences), criminal proceedings / investigations, outcomes and sentences.

How we use personal data

The main purposes for processing your personal data are:

  • To assess eligibility for Home to School transport
  • To make safe transport arrangements for Home to School travel for eligible children and young people
  • To make safe transport arrangements for adults referred through the Council’s Adult Social Care service
  • To promote sustainable travel and transport and make assessments for Independent Travel Training of children and young people
  • To assess suitability for drivers and passenger assistants.

Legal Basis for processing

The lawful basis we rely on for processing your personal data is:

  • It is necessary to fulfil a legal obligation under the following:
    • Education Act 1996 (in particular, Sections 508A, 508B; and Schedule 35B)
    • Care Act 2014.
  • It is necessary for the performance of a task carried out in the public interest or in the exercise of official authority 
  • Consent to access further training, including independent travel training
  • Contract (drivers and passenger assistants).

The condition we rely on for processing your special category data and criminal data is:

  • Reasons of substantial public interest - statutory etc and government purposes.

Who do we share personal data with?

In addition to the general reasons for data sharing described in the Council’s Primary Privacy Notice, we share and retrieve data with the following when required:

  • Other Council Departments including, but not limited to, Adult Social Care, Children and Families services, Education
  • Other local authorities
  • Educational establishments including schools and colleges
  • Government agencies
  • Disclosure and Barring Service (DBS)
  • Suppliers delivering a contract on behalf of the Council
  • Information you give us directly as an applicant, contracted driver or service user, or on behalf of the service user e.g. parent, guardian, carer
  • Adult Day Care providers.

This is not an exhaustive list. 

How long do we keep personal data?

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any future legal, accounting, or reporting requirements.

We must continue to retain necessary data in accordance with our corporate records policy to fulfil legal, statutory and regulatory requirements.

Automated decisions

All the decisions we make about you involve human intervention.

We will respond to all requests within one month.
