Introduction

Our core data protection obligations and commitments are set out in  Wigan Council Primary Privacy Notice

This notice provides additional privacy information for residents and businesses whom civil or criminal enforcement action may be taken.

What personal data do we collect?

To carry out activities and obligations as an Environmental Education and Enforcement Service we process the following personal data:

  • Name
  • Date of birth
  • Address
  • Telephone number
  • Email address
  • Financial information
  • Images via body worn cameras.

How we use personal data

The main purposes for processing your personal data are:

  • To investigate environmental crime and statutory nuisance
  • To issue fixed penalty notices, penalty charge notices and other legal notices for the enforcement of environmental and statutory nuisance contraventions and other associated investigation/enforcement purposes including, but not limited to:
    • Waste Accumulation Investigations
    • Fly Tipping Investigations
    • Littering Enforcement
    • Dog Fouling Enforcement
    • Abandoned vehicles
    • Fly posting
    • Misuse of litter bins
    • Household waste management
    • Commercial waste management
    • Overhanging vegetation
    • Smoke, fumes, gases dust and artificial light from premises, vehicles or equipment
    • Noise or vibration from premises or street equipment
    • Dog barking
    • Odour from industrial, trade or business premises
    • Accumulation of deposits of waste that are harmful to health or attract pests
    • Premises in such a state that they are a danger or harmful to health or attract pests.
  • To carry out roadside vehicle inspections (in joint operations with Police)
  • Prepare and collate information relating to environmental crime for prosecution.

Legal Basis for processing

The lawful basis we rely on for processing your personal data is:

  • It is necessary to fulfil a legal obligation under the following:
    • Environmental Protection Act 1990
    • Environment Act 2021
    • Dog (Fouling of Land) Act 1996
    • Anti-social Behaviour, Crime, and Policing Act 2013
    • Unauthorised Deposit of Waste (Fixed Penalties) Regulations 2016
    • The Microchipping of Dogs (England) Regulations 2015
    • Public Health Act 1936, Section 83 (filthy and verminous)
    • Clean Neighbourhoods and Environment Act 2005
    • Police and Criminal Evidence Act 1984
    • Highways Act 1980, section 154.
  • It is necessary for the performance of a task carried out in the public interest or in the exercise of official authority.

Who do we share personal data with?

In addition to the general reasons for data sharing described in the Council’s Primary Privacy Notice, we share and retrieve data with the following when required:

  • Other teams within Wigan Council
  • Other local authorities
  • Government agencies
  • Enforcement agencies
  • Police.

This is not an exhaustive list.

How long do we keep personal data?

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any future legal, accounting, or reporting requirements.

We must continue to retain necessary data in accordance with our corporate records policy to fulfil legal, statutory and regulatory requirements.

Automated decisions

All the decisions we make about you involve human intervention.
