Introduction

Our core data protection obligations and commitments are set out in Wigan Council Primary Privacy Notice.

This notice provides additional privacy information for the Education Business Intelligence Unit.

The role of the Education Business Intelligence Unit is to process, analyse and report on all Education, SEND and Post 16 data. We provide intelligence and insight to support schools, the education and wider children’s services as well as the Council and partners. Additionally, we provide services to schools under a service level agreement which means we process additional data to provide these services.

What personal data do we collect?

To carry out activities and obligations as the Education Business Intelligence Unit we process the following personal data:

  • Name
  • Date of birth
  • Address
  • Telephone number
  • Email address
  • Gender
  • Unique Pupil Number
  • Attendance, assessment and attainment records
  • Behavioural information (such as exclusions)
  • Free school meal entitlement, including Pupil Premium entitlement.

We also process the following special category data:

  • Health-related data, including special education needs
  • Ethnicity.

How we use personal data

The main purposes for processing your personal data are:

  • To support  the local authorities statutory duties in relation to the provision of education for pupils and students up to age 20
  • To produce statistical and performance information for schools and the Council to support funding and strategic decision making across all education services
  • To support schools with data and performance analysis
  • To submit statutory returns.

Legal Basis for processing

The lawful basis we rely on for processing your personal data is:

  • Legal obligation under the following legislation:
    • Education Act 2002
    • Children Act 2004
    • Care Act 2014.

The condition we rely on for processing your special category data is:

  • Reasons of substantial public interest: statutory etc and government purposes.

Who do we share personal data with?

In addition to the general reasons for data sharing described in the Council’s Primary Privacy Notice, we share data with and collect data from the following when required:

  • Other teams within Wigan Council including, but not limited to children’s social care and early help, youth services, careers services, youth services, SEND team, public health
  • Schools and other education providers
  • Government departments and agencies including, but not limited to, Department for Education, Department of Health and Social Care
  • NHS Integrated Care Board
  • Greater Manchester Combined Authority
  • Any other person or organisation exercising functions or are engaged in activities in relation to children and adults in the authority’s area.

This is not an exhaustive list.

How long do we keep personal data?

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any future legal, accounting, or reporting requirements.

We must continue to retain necessary data in accordance with our corporate records policy to fulfil legal, statutory and regulatory requirements.

Automated decisions

All the decisions we make about you involve human intervention.
