Our core data protection obligations and commitments are set out in Wigan Council Primary Privacy Notice.

This notice provides additional privacy information for Development Management and Building Control.

What personal data do we collect?

To carry out activities and obligations we process the following personal data:

  • Name
  • Title
  • Address
  • Telephone number
  • Email address
  • Date of birth
  • Bank account details.

We may also process the following special category data:

  • Information about any disability you may have i.e. health data.

How we use personal data

The main purpose for processing your personal data is to exercise our statutory functions as the Local Planning Authority and the Building Control Authority, including a duty to create and maintain a public register of planning applications.

Legal Basis for processing

The lawful basis we rely on for processing your personal data is:

The condition we rely on for processing your special category data is:

  • Reasons of substantial public interest: Statutory etc and government purposes.

Who do we share personal data with?

In addition to the general reasons for data sharing described in the Council’s Primary Privacy Notice, we collect from or share personal data with the following when required:

  • Other teams within Wigan Council
  • Other local authorities
  • The planning portal
  • Planning inspectorate
  • Idox Software Ltd
  • Statutory and non-statutory consultees
  • Specialist technical advisors appointed by the Council.

Your personal details will be included in the published register of planning applications (although home address, personal email address and signature will be removed). If you comment on a planning application, your personal data will be collected but will not be published. 

How long do we keep personal data?

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any future legal, accounting, or reporting requirements.

We must continue to retain necessary data in accordance with our corporate records policy to fulfil legal, statutory and regulatory requirements.

All the decisions we make about you involve human intervention.
