During the period from September 2014 to March 2018 the Local Authority is required to transfer all statements of Special Educational Needs (SEN) to Education, Health and Care (EHC) plans.
These transfers will usually take place at key transition points and you can find the timetable for the transfer in our transition plan for the transfer of statements to EHC plans.
EHC plans have the same legal status as statements of SEN and will cover the age range 0 to 25. An EHC plan for a 19 to 25 year old will only be maintained if they remain in education or training and specific educational provision is still required.
The education provision set out in the EHC plan has to be provided. Parents have the right of appeal to a tribunal if they are not happy with the education provision.
The council has produced two leaflets explaining the transfer process:
If you would like a printed copy you can request one by contacting us.
The process for transferring a statement to an EHC plan is described in the 'transfer review' section of the Guidance for Annual Review - Early Years and School-Age.
All the documents referred to within the document also have links below. Most of the documents are also used within the annual review process but two have been adapted to meet the requirements of the transfer review.
