The Road Traffic Act 1991 - Appeal Procedures

If you believe that the Penalty Charge Notice you have received should not have been issued or that there may be special reasons why it should be cancelled, the following notes explain the appeals procedure.  There are three stages of appeal.

Correspondence

If you have been issued a Penalty Charge Notice that you do not think fair then please write to the address below or you can challenge a Penalty Charge Notice online.

Please do not telephone as we are unable to accept appeals over the telephone.

We will investigate the points raised in your letter, make a decision as to whether or not the Penalty Charge Notice must be paid and let you know as soon as we can - usually within 28 days.  If we need to take longer you will be informed.

If your letter is received by us within the 14 days allowed for payment of the Penalty Charge at the discounted rate and we cannot cancel the ticket we will allow you another 14 days to pay at the discounted rate.

Representations

You may make formal representations to the Council only after receiving a Notice to Owner.  There are several grounds on which representations may be made and details of these are given on the Notice to Owner.

We will consider your representations and reply to you.  If the ticket cannot be cancelled you will be told the reasons why and sent a form which will allow you to appeal to the Parking Adjudicators.

Cancellation Policy

We have produced a document showing examples where we may or may not cancel a Penalty Charge Notice (PCN), including a list of contravention codes and descriptions currently enforced by Wigan Council. For each contravention there is an outline of the restriction and cancellation policy.

The Parking Adjudicators

  • Your case will be considered by an experienced lawyer who is independent of the Council.
  • You cannot appeal to the Parking Adjudicators until you have been told by the Council that your representations have been rejected.
  • You may choose whether to attend in person or deal with it by post.
  • The Adjudicators' decision is final and binding upon both you and the Council.
  • Appeals are held locally.
