The images on this web site will be only be accessible for a maximum of 31 days this is in line with the principles of Data Protection Act 1998. As soon as we can confirm identification of an individual featured on this site we will remove the image. Any photographs or CCTV images can be used in evidence for any prosecution of an environmental crime.
Article 8 of the Human Rights Act 1998 gives everyone the right to respect for private and family life, home and correspondence. Environment Services recognises that the Act requires public authorities to operate in a way that is compatible with those rights, subject to occasions when interference is justified. We will at all times seek to strike a fair balance between the needs to protect the rights of individual’s, residents, businesses, and the community.Wigan Council has a responsibility along with other Partners to prevent and detect crime and anti-social behaviour in our neighbourhoods. The individuals featured on this web site and in local papers have committed a criminal offence in a public place. Wigan Council have published their image so that we can identify them and take appropriate action to challenge their behaviour.
We will contact the individual and confirm his or her identification, this can mean that we visit the person at home.Once we are able to confirm his or her identification we will challenge the individual about their behaviour this could mean taking enforcement action including issuing a Fixed Penalty Notice or prosecution.
Everyone is responsible for their behaviour after the age of 10, anyone caught committing a crime should be challenged. Identification is the first step to raising awareness of environmental crime.
