Industrial Air Pollution

Investigate complaints and enquiries about dark smoke and potential statutory nuisance from smoke, odour, and fumes from industrial premises.

Part I of the Clean Air Act 1993, deals with controlling emissions of dark and black smoke from chimneys serving furnaces of fixed boilers or industrial plant. It also deals with emissions of dark smoke from industrial or trade premises caused by burning materials in the open. Subject to certain limited exemptions, emission of dark or black smoke is an offence.

Part 3 of the Environmental Protection Act 1990 requires us to take reasonable steps to investigate and, if appropriate, to take formal action to address various forms of pollution.

If the pollution cannot be resolved voluntarily and is severe enough to be classed as a statutory nuisance, the Council will serve an Abatement Notice on the person responsible requiring that action is taken.

Officers will investigate the circumstances of the case. We may ask you to complete diary sheets showing how the pollution affects you. Officers may also visit you and the pollution source to assess whether a statutory nuisance exists.
