Parents’ right of objection
Under Section 88H(3) of the School Standards and Framework Act 1998 a parent may refer an objection to admission arrangements to the adjudicator.
A parent may only refer an objection if the objection relates to pre-existing selection arrangements where they are the parent of a child of compulsory school age receiving primary education and are resident in the relevant area for consultation relating to those admission arrangements.
A parent may only refer an objection if the objection relates to an admission number for any relevant age group which is lower than the indicated admission number for that age group where they are the parent of a child who has attained the age of two and is receiving primary education and are resident in the relevant area for consultation relating to those admission arrangements. The adjudicator is required to determine an objection on these grounds only where not less than ten such parents have referred objections about the same admissions arrangements and raise the same, or substantially the same, issue.
A parent may only refer an objection where any aspect of the admissions arrangements does not comply with any mandatory requirements in the School Admissions Code or Part 3 of the School Standards and Framework Act 1998 where (in the case of an objection to arrangements for admission for sixth form education) they are a parent of a child who is or will be, eligible to apply to the school whose admission arrangements are the subject of an objection and, in any other case, the parent of a child who has attained the age of two but is not above compulsory school age.
Objections can be sent to: The Secretary, Office of the Schools Adjudicator, Mowden Hall, Staindrop Road, Darlington, DL3 9BG. Any objections must be sent by 31 July 2010.
