45.1 Exclusion of the public – Section 100a Local Government Act 1972: Resolved: The public is excluded from the meeting when the Committee discusses the following item for the reason set out below:

 E1  To hear an appeal against dismissal by an employee in Children and Young People’s Services 45.2 1 (information about any named person).

45.2 To hear an appeal against dismissal by an employee in Children and Young People’s Services: The Head of Peoples Services, Alison McKenzie-Folan, informed the Committee that an employee from Children and Young People’s Services had submitted an appeal against dismissal. Management had submitted written and oral evidence to support their case. The appellant and her representative submitted written and oral evidence to support their case.

During the appeal, management called four witnesses.

The Chairman adjourned the meeting to deliberate and reach a decision.

Resolved: The Committee upholds management’s decision and the appeal is dismissed.

46 Hackney Carriage Licence – suspension: The Committee considered a report of the Executive Director of Environmental Services, Martin Kimber, presented by Licensing Officer, Tony Tuffin, which advised Members of the result of a deferred decision.

The item had previously gone to a meeting of the Regulation Sub Committee (minute 40.2 refers) but was deferred to allow the proprietor time to obtain a replacement vehicle. This had been done, and following inspection, the vehicle had been found to be of a suitable and safe condition.

Resolved: The Committee notes the report.

47 Application for a licence to drive private hire vehicles: The Committee considered a report of the Executive Director of Environmental Services, which advised Members of an application for a licence to drive private hire vehicles.

The applicant attended the meeting and answered questions.

Resolved: The application is refused.

(Councillor P A Liptrot declared a prejudicial interest in this item as he is a friend of one of the applicant’s referee’s and left the meeting during discussion thereon. Councillor W Rotherham declared a prejudicial interest in this item as he knows the applicant’s employer and left the meeting during discussion thereon.)

48 Application for a licence to drive private hire vehicles: The Committee considered a report of the Executive Director of Environmental Services, which advised Members of an application for a licence to drive private hire vehicles.

The applicant attended the meeting and answered questions.

Resolved: The application is granted with a severe warning regarding the driver’s future conduct.

(Councillor P Prescott declared a prejudicial interest in this item as the applicant is known to him and left the meeting during discussion thereon.)

49 Application for a licence to drive private hire vehicles: The Committee considered a report of the Executive Director of Environmental Services, which advised Members of an application for a licence to drive private hire vehicles.

The applicant and his representative attended the meeting and answered questions.

Resolved: The application is refused.

50 Private hire driver – conviction: The Committee considered a report of the Executive Director of Environmental Services, which advised Members of a currently licensed private hire driver cautioned for an offence.

The driver attended the meeting and answered questions.

Resolved: The driver is issued with a warning regarding his future conduct.

(Councillor J Eccles-Churton declared a prejudicial interest in this item as he knows the complainant involved in the police case and left the meeting during discussion thereon.)

51 Private hire driver – conviction: The Committee considered a report of the Executive Director of Environmental Services, which advised Members of a currently licensed private hire driver convicted of an offence involving dishonesty.

The driver attended the meeting and answered questions.

Resolved: The driver is issued with a severe warning regarding his future conduct.
