- In respect of application A/08/71315, formation of access road to existing dwellinghouse at Southerns Fold, the Committee requests the Executive Director of Environmental Services to take appropriate enforcement to have the access road removed and return the site to its natural habitat.

Reason: The proposed two storey side extension would, by reason of its height, scale, massing and inadequate distance from the rear elevation of No.23 Parklands Drive, be unduly overbearing and result in an unacceptable outlook, overshadowing and loss of amenity to the occupiers of that property contrary to the aims and objectives of Policy R1D of the Wigan Replacement Unitary Development Plan.

Reason: The site is situated within an area of land which forms part of the Green Belt and the proposal results in inappropriate development that unduly impacts upon the character and openness of the Green Belt and no very special circumstances have been demonstrated to outweigh the harm caused. Therefore the proposal is contrary to Policy GB1 of The Unitary Development Plan which strictly limits development in the Green Belt in accordance with advice contained in PPG2.

A/09/73219 To extend dwellinghouse - detached garage to rear (Amendment to A/09/72853 - Increase in height of garage from 3m to 4.6m)

Conditions:
1. With the exception of the detailed matters referred to by the conditions of this consent, the development hereby approved shall be carried out in accordance with the details shown on plan reference 111/PL01 Rev A received 03.09.2009, and 111/PL02A received 05.08.2009, and 111/PL03 received 23.09.2009, or any other plan agreed in writing as a working amendment by the Local Planning Authority.
2. The materials used on the external surfaces of the proposed garage, including elevations and roof, shall match in colour, size, form and texture those on the existing dwellinghouse.
3. Prior to the commencement of any development, details of the construction of the driveway between the garage and Woodlands Road shall be submitted to and approved in writing by the Local Planning Authority. Any new hard surface shall be made of porous materials, or provision shall be made to direct run-off water from the hard surface to a permeable or porous area or surface within the curtilage of the dwellinghouse. The duly approved scheme shall be implemented in full prior to first occupation of the approved garage, and shall be retained thereafter.
4. Notwithstanding the details indicated on approved plan 111/PL01 Rev A, visibility splays of 2.4 metres by 2.4 metres shall be provided at the junction of the new vehicle access with the footway on Woodlands Road. No obstruction in excess of 900mm shall be placed within the splay line at any time.
5. Notwithstanding the details shown on the approved plans, no additional windows shall be inserted at any time into any roof plane, except with the prior written approval of the Local Planning Authority.
6. The garage hereby approved shall not be used at any time for any trade or business purposes, including any associated storage use.
Reasons:
1. For the avoidance of doubt, and having regard to Policy EV3A of the replacement Wigan UDP.
2. To ensure that the external appearance of the buildings is satisfactory, having regard to Policy EV3A of the replacement Wigan UDP.
3. To reduce surface water run-off, in accordance with Policy G1C of the Replacement Wigan UDP.
4. To provide for the safety and convenience of users of the highway, for the free flow of traffic, and to safeguard the amenity of neighbouring premises, in accordance with Policies A1R and R1D of the replacement Wigan UDP.
5. To prevent overlooking to neighbouring property, as required by Policies R1D and EV3A of the replacement Wigan UDP.
6. To safeguard the amenity of the adjoining premises and the area in general, having regard to Policy G1A of the Replacement Wigan Unitary Development Plan.
