16 Development Control performance in 2008/09: The Service Director – Development, presented a report, which informed Members of the performance of the Development Control service during the last financial year and in comparison with previous years and national performance levels.
The Committee was advised that Wigan’s Development Control performance during the last financial year demonstrated a continuous improvement, in particular it showed that :-
- the Council’s performance continued to exceed targets within the Best Value Performance Indicators;
- the Council’s application approval rate remained high;
- the Council’s enforcement performance was of high quality and effective; and
- the Council’s appeals record was better than the national average.
Resolved: The Committee notes the report.
17 Information items: The Service Director – Development, advised the Committee of a planning training event which would be held at the Hilton Hotel, Blackpool on Friday 25 September 2009.
Members were advised that only one place was available and were requested to indicate if they wished to attend the event following receipt of the event outline which would be emailed to Members.
Resolved: The Committee authorises the Service Director – Development, to collect responses from those Members wishing to attend the training event and make the necessary arrangements.

or any other plan agreed in writing as a working amendment by the Local Planning Authority.
2. Before any part of the development hereby approved is commenced, particulars/samples of the materials to be used for the external surfaces of the dam structure, associated hard surfaces, and of the replacement footbridge, shall be submitted to and approved in writing by the Local Planning Authority. The specification shall take into account the need to minimise the susceptibility of the surfaces to damage from graffiti or other unauthorised activity. The development shall be constructed only in accordance with the approved materials.
3. Prior to the commencement of any development, a detailed specification for the design, materials, finishes, and siting of all railings, security fences, gates and barriers shall be submitted to, and approved in writing by, the Local Planning Authority. The development shall be implemented fully in accordance with the approved details.
4. Prior to the commencement of works to lower Haigh Hall Bridge, as indicated on approved plan B0993500-151, a detailed specification/ programme of works, including replacement railings and any remedial repairs to stonework, shall be submitted to and approved in writing by the Local Planning Authority. The flood alleviation structure hereby approved shall not be brought into operation until the works to Haigh Hall Bridge have been completed in full accordance with the agreed details.
5. No development hereby approved shall be commenced until the temporary access arrangements as specified on drawing B0993500/161 Option 2 Rev A03, including signage and entrance barrier, has been constructed and made available for use. The approved access shall be retained during the construction of the flood alleviation scheme, unless otherwise agreed in writing by the Local Planning Authority. The barrier shall remain closed outside the authorised hours of vehicle movements. Within one month of the completion of the development, the access shall be permanently closed and the footway crossing re-instated in accordance with a specification to be submitted to and approved in writing by the Local Planning Authority..
6. Before the development hereby approved is brought into use all plant and machinery shall be enclosed with sound insulating material in accordance with a scheme previously agreed in writing by the Local Planning Authority.
7. No development shall be started until an investigation and assessment of the nature and extent of any contamination of the site has been submitted to and approved in writing by the Local Planning Authority. The assessment shall identify any remedial measures required to deal with any hazards identified and such measures shall be implemented before the occupation of any of the buildings hereby permitted.
8. No construction activities, including the operation of plant and equipment, and the movement of Heavy Goods Vehicle associated with the transportation of materials to, from and around the site, shall not take place except between 08.00 hours and 18.00 hours on Monday to Friday (excluding Bank Holidays), and between 08.00 hours and 13.00 hours on Saturday, and at no times on Sunday, except with the prior written approval of the Local Planning Authority.
9. Prior to the commencement of any development, a scheme detailing the measures to be employed to control and monitor noise arising from the development of the site shall be submitted to, and approved in writing by, the Local Planning Authority. The development shall be undertaken fully in accordance with such approved measures.
10. Prior to the commencement of development, a scheme detailing the measures to be employed to control and monitor dust emissions resulting from the development of the site shall be submitted to, and approved in writing by, the Local Planning Authority. The development shall be undertaken in full accordance with such approved measures.
11. No development hereby approved shall be commenced until the applicant has secured the implementation of a programme of archaeological work, in accordance with a written scheme of investigation which has been submitted to, and approved in writing by, the Local Planning Authority.
12. No development shall be commenced until a Woodland and Ecological Mitigation and Management Plan (WEMMP) has been submitted to, and approved in writing by the Local Planning Authority. The Plan shall provide details of measures to ensure the establishment of an accurate baseline of woodland and ecological information, the arrangements for the subsequent monitoring, and the arrangements and timeframe for the implementation of the planting of replacement trees following a flood event and the mitigation measures for any adverse impact resulting from the development. The development shall be implemented fully in accordance with the approved plan.
13. Prior to the commencement of the development, details of arrangements, including a timetable, for the implementation of the ecological mitigation measures in respect of otters, kingfishers, bats, and water vole as specified in the Environmental Assessment and EA Addendum, shall be submitted to and approved in writing by the Local Planning Authority. The measures shall be implemented in full accordance with the agreed details, unless otherwise agreed in writing by the Local Planning Authority.
14. Prior to the commencement of the development, details of the construction and surfacing of proposed new and reinstated footpaths, cycleways and bridleways, including a timetable for implementation of those works, shall be submitted to and approved in writing by the Local Planning Authority. The works shall be implemented fully in accordance with the approved details and timetable.
15. Prior to the commencement of any development, details of a scheme for the provision of an interpretation board to commemorate the history of Sutton Mill and Bottling Wood shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall include details of the siting and design of the board, and the arrangements for its future maintenance. The approved scheme shall be completed before the flood alleviation structure hereby approved is first brought into use.
16. Prior to the commencement of any development, details of the arrangements for the provision of the areas of planting as referred to in the Environmental Assessment and EA Addendum and on drawings B0993500-1841, 1842, 1843 and 1844 , including a timetable for their implementation, details of their specification and design and future maintenance, shall be submitted to and approved in writing by the Local Planning Authority. The measures shall be implemented in full accordance with the agreed details, unless otherwise agreed in writing by the Local Planning Authority.
Reasons:
1. For the avoidance of doubt, and having regard to Policy EV3A of the replacement Wigan UDP.
2. To ensure that the external appearance of the development is satisfactory, having regard to Policy EV3A of the replacement Wigan UDP.

4. To ensure that the physical integrity and external appearance of the structure is satisfactory, having regard to Policies EV3A and EV4C of the replacement Wigan UDP.

6. The insulation of plant and machinery which generate high levels of noise will reduce the impact of the proposal on existing development in the vicinity, in accordance with Policies EV1B and G1A of the replacement Wigan UDP.
7. To ensure that any contamination is investigated and treated to the satisfaction of the Local Planning Authority, during the carrying out of the development as required by Policy EV1B of the replacement Wigan UDP.
8. To safeguard the amenities of the adjoining premises and the area generally, having regard to Policy G1A of the replacement Wigan UDP.

13. The site contains valuable wildlife which should be protected and conserved, in accordance with Policy EV2 of the Replacement Wigan UDP.
14. To secure the provision of satisfactory replacement access in accordance with Policies A1C, A1D and A1E of the Replacement Wigan UDP.
15. The Local Planning Authority considers the site is of archaeological interest and wishes to ensure the history is adequately commemorated, as required by Policy EV4E of the replacement Wigan UDP.
