Licensing Sub-committee meeting - Wednesday 22 July 2009

Minutes of the Licensing Sub-Committee meeting held at the Town Hall, Library Street, Wigan on Wednesday 22 July 2009.

1 Apologies for Absence: none.

2 Application for a variation of a premises licence: Pier, Pottery Road, Wigan: The Sub Committee considered a report of the Executive Director Environmental Services, Martin Kimber, which set out details of an application for a variation of a premises licence for which four letters of representation had been received. A representation from a responsible authority, the Council’s Environmental Protection Section, had also been received.

The applicant and his representative attended the meeting and answered questions. Two interested parties attended the meeting and answered questions. The responsible authority and their representative attended the meeting and answered questions.

Resolved: The application is granted as amended above with the following two conditions attached:

Condition 1 PPN4 (variation of)

Except for access and egress, all external doors and windows shall be kept closed when regulated entertainment is being provided except in the case of an emergency, and the first floor fire exit door, to allow customers who smoke access to the canal towpath.

Condition 2 PPN 6

The licence holder or his representative shall conduct regular assessments of the noise coming from the premises on every occasion the premises are used for regulated entertainment and shall take steps to reduce the level of noise where it is likely to cause noise to local residents. A written record shall be made of those assessments in a log book kept for that purpose and shall include, the time and date of any checks, the person making them and the results including any remedial action.

Condition 3 PPN 7

There shall be placed at all exits from the premises in a place where they can be seen and easily read by the public, (or member and their guests) notices requiring customers to leave the premises and area quietly.

Condition 4 PPN 8

Refuse such as bottles shall be disposed of from the premises at a time when it is not likely to cause disturbance to residents in the vicinity of the premises. Such refuse shall not be disposed of between 23:00 and 07:00

Condition 5 As yet to be agreed

The Committee notes that the Dispersal and Car Park Management Policy has been submitted but, the Environmental Protection Officers require further time to consider whether the policy is appropriate. Given these circumstances, any condition in respect of this matter will be agreed between the applicant and the Environmental Protection Section. This condition is then to be submitted to the Licensing Sub-Committee for consideration to attach to the premises licence.

 Condition 6

Noise of music and associated sources (including DJ’s and amplified music) should generally not be audible inside noise sensitive properties at any time with windows open in a typical manner for ventilation.

Condition 7

An environmental noise assessment shall be carried out and a report shall be submitted to the Licensing Authority for approval within one month from the date of hearing. All approved mitigation measures in the report shall be completed and fully implemented within 3 months from the date of the hearing.

The environmental noise assessment and report should consider the control of noise at source and insulation of the building and detail the measures to be taken to meet the requirements of condition 6.

(The Environmental Protection Section will provide detailed advice to the applicant on the scope of the environmental noise assessment if required)

Condition 8

The applicant shall defer opening on a Sunday preceding the Bank Holiday Monday until all of the approved mitigation measures are completed and fully implemented.
