1 Welcome to new Members: The Committee welcomed the new Chairman, Councillor P Prescott and also Councillor Mrs J Beswick.

2 Apologies for Absence: Councillors S C Barnes Dr C M Cottam, Mrs Y Klieve and P A Liptrot

3 Minutes: The minutes of the meeting of this Committee held on 3 April 2009 were approved as a correct record.

5.1 Exclusion of the public – Section 100a Local Government Act 1972: Resolved: The public is excluded from the meeting when the Committee discusses the following item for the reason set out below:

 E1 To hear an appeal against dismissal by an employee in the Environmental Services Department  5.2  1 (information about any named person).

5.2 To hear an appeal against dismissal by an employee in the Environmental Services Department: The Head of People’s Services informed the Committee that an employee from the Environmental Services Department had submitted an appeal against dismissal. Management had submitted written and oral evidence to support their case. The appellant and his representative submitted written and oral evidence to support their case.

During the appeal, management called two witnesses.

The chairman adjourned the meeting to deliberate and reach a decision.

Resolved: The Committee decided overturn management’s decision and the appeal is upheld. The appellant’s employment is s re-instated to 5 March 2009 on a final written warning which will run for a period of twelve months from that date.

6 Minutes of the Regulation Sub Committee: Resolved: The minutes of the meeting of the Regulation Sub Committee held on 24 April 2009 were approved as a correct record:-

6.2 Private Hire Vehicle Licence - suspension: The Sub Committee considered a report which advised Members of a suspension of a private hire vehicle licence.

The applicant did not attend the meeting.

Resolved: (1) This item was deferred to allow the applicant to attend a future meeting.

(2) Should the applicant fail to attend a future meeting, the application may be heard in his absence. Chairman

7 Application for the grant of a street trading consent: The Committee considered a report of the Executive Director of Environmental Services, which advised Members of an application for a street trading consent.

The applicant attended the hearing and answered questions.

The applicant agreed to keep the area free from litter and to clean up the surrounding area each evening after close of business.

Resolved: The Committee grants the licence.

8 Application for the grant of a street trading consent: The Committee considered a report of the Executive Director of Environmental Services, which advised Members of an application for a street trading consent.

The applicant attended the hearing and answered questions.

Written representations were received from the Greater Manchester Police.

Resolved: The Committee grants the licence.

(The Chairman, Councillor P Prescott, declared a personal interest in this item and vacated the Chair during discussions thereon. Councillor W Rotherham, Vice Chairman, took the Chair for this application.)

9 Application for the grant of a licence to drive private hire vehicles: The Committee considered a report of the Executive Director of Environmental Services, which advised Members of an application for a licence to drive private hire vehicles.

The applicant and his representative attended the meeting and answered questions.

Resolved: The Committee grants the application.
