47.2 To hear a grievance appeal by four employees in the Environmental Services Department: The Head of People’s Services informed the Committee that four employees of the Environmental Services Department had submitted a grievance appeal against actions taken by management. Management had submitted written and oral evidence to support their case.
The appellants and their representatives, together with representatives of management then entered the meeting. During the appeal, management called two witnesses. Each side submitted their case to the Committee and answered questions.
The chairman adjourned the meeting and the Committee re-convened on Thursday 15 January 2009 to deliberate and reach a decision.
Resolved: The Committee decided uphold management’s actions and reject the employees’ claims.

48 Dates and times of meetings 2009/10: The Committee considered a draft programme of dates and times of meetings of Council and Committee’s for 2009/10. Cabinet at minute 193 had invited comments from the Committees.
Resolved: The Committee endorses the draft programme of dates and times of meetings for 2008/09 now submitted.
49 Consultation on the provision of accessible hackney carriages: The Committee considered a report of the Executive Director of Environmental Services, which advised Members of a letter received from Ian McCartney M.P. and of representations made by representatives of the hackney carriage trade regarding the decision made by this Committee at its meeting held on 16th January 2009 in respect of the provision of accessible hackney carriages.
Resolved: The Committee notes the report and approves the propsals that implementation of the policy on accessible hackney carriages as determined on 16th January 2009 be deferred until 1st April 2010, and that a focus group consisting of members of the hackney carriage and private hire trades, representatives of the local disabled groups and officers from the Licensing Section, chaired by an elected member of the Regulation Committee should be formed.

51 Private hire vehicle driver - complaint: Resolved: This item was deferred until the meeting of 13 March 2009.
52 Suspension of Private Hire Vehicle Licence: The Committee considered a report of the Executive Director of Environmental Services, which advised members of the suspension of a private hire vehicle licence.
Officers advised Members that the vehicle proprietor had surrendered the licence and the vehicle was therefore no longer licensed as a private hire vehicle. The officers requested that any further applications made on this vehicle should be made to this committee.
Resolved: The Committee recommends that any further application to license this vehicle as a private hire or hackney carriage should be brought before the Committee.
53 Application for the grant of a licence to drive private hire vehicles: The Committee considered a report of the Executive Director of Environmental Services, which advised Members of an application for a licence to drive private hire vehicles.
The applicant attended the hearing and answered questions.
Resolved: The Committee refuses to grant the application on the grounds that the applicant is not a fit and proper person to hold a private hire drivers licence.
54 Application for the renewal of a licence to drive private hire vehicles and breach of licence conditions: The Committee considered a report of the Executive Director of Environmental Services which advised Members of an application for renewal of a licence to drive private hire vehicles and of a breach of licence conditions by the applicant.
The applicant attended the hearing and answered questions.
Resolved: The Committee refuses to grant the application on the grounds that the applicant has, since the grant of the licence, received three fixed penalty notices and failed to comply with the conditions attached to that licence.
