30.2 To hear an appeal against dismissal by an employee in the Environmental Services Department: The Head of Personnel informed the Committee that an employee of the Environmental Services Department had submitted an appeal against dismissal. Management had submitted written and oral evidence to support their case.
The appellant and his representative, together with representatives of management then entered the meeting. During the appeal, management called two witnesses. Each side submitted their case to the Committee and answered questions.
Both sides withdrew from the meeting whilst the Committee considered its decision.
Resolved: The Committee decided to uphold the appellant’s appeal and recommended that the appellant is taken back to stage 2 of the sickness absence procedure, as a consequence of that, management will set an appropriate review period. In addition, the appellant will be offered the services of a support officer to deal with skills analysis and reasonable adjustments under DDA.

32 Smoking and teenagers – ‘Kiss my Butt’ drama: The Committee considered a report, informing Members about the recent initiative ‘Kiss my Butt’ – a drama to encourage teenagers to think about the health impact of smoking. The play had been a huge success across the borough and provided teenagers with the challenge of thinking about the issues around smoking and how it related to them as individuals.
Resolved: The Committee notes the report now submitted.
33 Private hire driver - complaint: The Committee considered a report from the Executive Director of Environmental Services, which advised Members of a complaint concerning a currently licensed private hire driver as not being a fit and proper person to hold a licence. The driver did not attend the hearing
Resolved: The Committee suspends the private hire driver’s licence for the reasons as outlined in the report.
34 Suspension of private hire vehicle: The Committee considered a report from the Executive Director of Environmental Services, which advised Members of the suspension of a private hire vehicle licence.
The applicant and his representative attended the hearing and answered questions.
Resolved: The Committee will allow the applicant to carry out repairs to the vehicle and to have the vehicle re-inspected and if it meets the Council’s fitness standards, to lift the suspension.
35 Unlicensed hackney carriage driver – conviction: The Committee considered a report which informed Members of a previously licensed hackney carriage driver being convicted at Wigan Magistrates Court for driving a hackney carriage whilst not holding a current and valid hackney carriage driver’s licence.
