20 Minutes of the Regulation Sub Committee: Resolved: The Committee confirms the minutes of the meetings of the Regulation Sub Committee held on 27 June, 4 July and 25 July 2008 and the Regulation Ad Hoc Committee held on 4 August and 11 August as set out below:-

20.1 Exclusion of the public – Section 100a Local Government Act 1972: Resolved: The public is excluded from the meeting when the Sub Committee discusses the following items for the reasons set out below:

20.2 Application for a private hire vehicle licence: The Sub Committee considered a report which advised Members of an application for a private hire vehicle licence. At the time of the vehicle inspection, the Council’s vehicle inspectors did not consider that it was in a suitable or safe mechanical condition to be licensed as a private hire vehicle.

The applicant attended the meeting and answered questions.

Resolved: The Sub-Committee will allow the applicant to carry out repairs to the vehicle and to have the vehicle re-inspected and if it meets the Council’s fitness standards, to grant a licence.

21 Application for the registration of land known as The Village Green – Higher Green Lane, Astley Green, Tyldesley as a town or village green: The Committee considered a report, from the Service Director Borough Solicitor requesting the Members to determine an application to register land known as the Village Green, Higher Green Lane, Astley Green, Tyldesley as a town or village green.

Resolved: The Committee agrees:-

  • that it is no longer necessary to hold a non-statutory Public Inquiry to determine the application and the application should be determined by this Regulation Committtee; and
  • that the application to register the land known as the Village Green, Higher Green Lane, Astley Green, Tyldesley should be accepted, on the basis the application satisfies the statutory definition of a village green, and the land should therefore be registed as a village green under Section 13 of the Commmons Registration Act 1965.

22 “Who’s got the bottle?”: The Committee considered a report, from the Executive Director of Environmental Services, which informed Members of work being undertaken with schools to reduce levels of anti social behaviour, in particular those which involved young people who had consumed alcohol.

The Committee was advised that the ‘Who’s Got The Bottle’ project consisted of a proposed series of themed drama productions aimed at year 9 High School pupils based around the youth/alcohol agenda and would focus on under-age sales, proxy sales and related wider social issues of alcohol misuse. To date expressions of interest had been received from 14 of the 20 High Schools within the borough to take part in the project.

Resolved: The Committee:-

  • notes the report now submitted; and
  • agrees to attend the drama productions, which are to be showcased at Lowton Civic Hall on 27, 28 and 29 January 2009.

23 Application for the grant of a licence to drive private hire vehicles: The Committee considered a report, from the Executive Director of Environmental Services which advised Members of an application for a licence to drive private hire vehicles.

The applicant attended the hearing and answered questions.

Resolved: The Committee grants the application but with a severe warning regarding the driver’s future conduct.
