25 Former Kingshill School, Tyldesley, development brief: The Committee considered a report that advised Members of the draft development brief that had been prepared in respect of the former Kingshill School site, Tyldesley.
The report set out details of the alternative options to be considered. The reason for selecting the one recommended was that to not provide a brief would lead to developer uncertainty and a potentially smaller financial receipt. The development brief also provided the opportunity to make clear the Council’s intention to retain a substantial building of local interest.
Resolved: The Planning Committee:-
- endorse the development brief; and
- recommends Cabinet to approve the draft development brief and refer it to the Head of Property Services for inclusion within the Sales Particulars.
26 Tyldesley Town Centre conservation area appraisal: The Committee considered a report that informed Members of the results of a consultation of Tyldesley Town Centre conservation area appraisal and management proposal.
The consultation had resulted in two proposed boundary changes to the existing conservation area, in order to promote the historic development of the town and to highlight its varied industrial heritage.
There were no alternative options available for consideration.
Resolved: The Planning Committee notes the revised Tyldesley Town Centre conservation area appraisal, which will become a material consideration in the assessment of future planning applications.
27 Information items: There were no information items.
28 Places Need Vision seminar: The Chairman of the meeting agreed to consider this additional item as urgent, the special circumstance being the need to make a provisional booking of places as soon as possible.
The Director of Environmental Services informed the Committee that Wigan Council had been allocated two places for Members of the Planning Committee to attend a seminar in October 2008 on Places Need Vision.
Resolved: Councillors J Hilton and G A Fairhurst are allocated the two places available for the seminar.
29 Elected Members’ summer school: The Chairman of the meeting agreed to consider this additional item as urgent, the special circumstance being the need to make a provisional booking of places as soon as possible.
The Director of Environmental Services invited Members to indicate if they wished to book a place at the Elected Members’ summer school which this year would be held at St Andrews University, Edinburgh on 29 August 2008.
Resolved: The Committee authorises the Director of Environmental Services to book a place for Councillor J D Hodgkinson at the Elected Members’ summer school to be held at St Andrews University, Edinburgh on 29 August 2008.
30 Planning proposals: The Committee considered planning and related applications which had been submitted to the Council. Reports and associated documentation and representations had been circulated with the agenda.
Resolved: (1) The decisions of the Committee on the planning and related applications are as set out in the schedule attached.
(2) In respect of application A/08/71381, 60 Park Road, Wigan, the officers’ recommendation was to approve the application with conditions. The Members resolved to refuse the application for the following reason:-
- The proposal would introduce a hot food takeaway in close proximity to existing residential properties and would result in a detrimental impact on the amenities of these local residents by reason of late night noise and disturbance and on street parking contrary to the aims and objectives of Policy S1D and Policy G1A of the Replacement Unitary Development Plan and the Council's Supplementary Planning Guidance on Hot Food Establishments.
- The application has failed to provide adequate and sufficient information in order to demonstrate that the odour extraction system, including the design of the proposed flue, is adequate to discharge odours to a satisfactory level, having regard to the amenity of adjoining residential properties from smells and the visual appearance of the rear of the property when viewed from the surrounding area. The proposal is therefore contrary to the aims and objectives of Policy G1A and EV3A of the Wigan Replacement Unitary Plan and the Council's Supplementary Planning Guidance for Hot Food Establishments.
The motion to refuse the application was proposed by Councillor R Clayton for the above reasons. He stated that the proposal would have a negative impact on the neighbouring property and local residents. He also stated that parking and access to the proposal was inadequate. Councillor G A Fairhurst seconded refusal of the application for the above reasons. The vote on the motion to refuse the application was carried 11 votes to 0.
(3) In respect of application A/08/71048, listed building consent for partial demolition of Municipal Buildings (retained façade) and erection of new structure, the Committee authorises the Director of Environmental Services to forward the application to the Secretary of State for Communities and Local Government in accordance with the provisions of the Planning (Listed Buildings and Conservation Areas) Act 1990 and the Planning (Listed Buildings and Conservation Areas) Regulations, 1990 and indicate that the Local Planning Authority would be minded to approve the application subject to conditions.
(4) In respect of application A/08/71049, conservation area consent for demolition of 17 – 19 The Wiend, Children’s Library and partial demolition of Municipal Buildings, the Committee authorises the Director of Environmental Services to forward the application to the Secretary of State for Communities and Local Government in accordance with the provisions of the Planning (Listed Buildings and Conservation Areas) Act 1990 and the Planning (Listed Buildings and Conservation Areas) Regulations, 1990 and indicate that the Local Planning Authority would be minded to approve the application subject to conditions.

2. No development should be undertaken until the applicant has secured the implementation of a programme of archaeological work to be undertaken in accordance with a written scheme of investigation approved by Wigan Council as Local Planning Authority.
3. Within 12 months of the commencement of the development a scheme for commemorating the heritage of the site by the display of features/artefacts and/or the erection interpretation display boards in the areas of public open space or in the buildings regarding; the archaeological remains found at the site, the location of 17-19 the Wiend, and the medieval route across the Wiend shall be submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be implemented before first use of Municipal Buildings.
4. Before any part of the development hereby approved is commenced on the northern and southern sites, and notwithstanding any previously submitted details, particulars/samples of the materials to be used for the external walls, roofs and entrances for each respective building shall be submitted to and approved in writing by the Local Planning Authority. The development of each building shall be constructed only in accordance with the approved materials.
5. The site shall be treated in accordance with a landscape scheme to be submitted to and approved in writing by the Local Planning Authority before any part of the development is commenced and all works in accordance with the scheme shall be completed within a period of 36 months from the date on which development in accordance with the permission hereby granted is first commenced, or such longer period as may be agreed by the Local Planning Authority, having regard to planting seasons, such landscape scheme to include; the planting of live trees, the treatment of the piazzas, the Wiend, pavements, the steps between Millgate and the piazza, and boundaries. All planting shall be maintained for a period of 5 years from the agreed date of planting.
6. Before any part of the development is commenced on the northern and southern sites, particulars of the rainscreen construction in relation to the panel size and joint details for each respective building shall be submitted to and approved in writing by the Local Planning Authority. The development of each building shall be carried out only in accordance with the approved details.
7. Notwithstanding the details submitted with the application a full Travel Plan for the site shall be submitted to and approved in writing by the Local Planning Authority prior to first occupation of the buildings (either as 1 plan relating to both buildings or individually). The full travel plan(s) shall set out measures, management, monitoring and implementation arrangements including timescales.
8. Notwithstanding the details submitted with the application within 12 months of the commencement of development full details of the location and specification for the provision of cycle storage facilities within the site shall be submitted to and approved in writing by the Local Planning Authority. Such approved cycle storage facilities shall be fully provided before the first use of the buildings hereby approved commences and thereafter retained.
9. No works shall take place to Municipal Buildings until English Heritage and/or other nominated person(s) have been allowed to make a photographic record of Municipal Buildings. This must be carried out by a professionally qualified archaeological/building recording consultant or organisation in accordance with a written scheme of investigation which shall first have been submitted to and agreed in writing by the Local Planning Authority. Upon completion the photographic record of the building shall be submitted to the Local Planning Authority.
10. Loading/unloading and manoeuvring of goods vehicles using northern piazza shall not take place during the following hours, namely:
- 10.30-am - 4.00 pm Monday – Sunday
unless alternative hours have previously been agreed in writing by the Local Planning Authority.
11. Notwithstanding the details submitted with the application no development shall be commenced until details of the proposed shared surfaces to include materials, colour and means of construction shall be submitted to and approved in writing by the Local Planning Authority. The development shall be constructed only in accordance with the approved materials unless alternatives are agreed.
12. Notwithstanding the details submitted with the application within 12 months of the commencement of the development details of the proposed disabled parking provision (including location, surfacing, means of delineation) shall be submitted to and approved in writing by the Local Planning Authority. The development shall be carried out only in accordance with the approved details.
13. Notwithstanding the details submitted with the application no development shall be commenced until the following information has been submitted to and approved in writing by the Local Planning Authority: (i) a full site survey showing:
- the datum used to calibrate the site levels
- levels along all site boundaries
- levels across the site at regular intervals
- floor levels of adjoining buildings
(ii) full details of the proposed finished floor levels of all buildings and hard surfaces, including showing how levels relate to land adjoining the site and how provision is to be made to all access for all users.
The development shall be carried out only in accordance with the approved details.
14. Notwithstanding the details submitted with the application within 12 months of the date of commencement details of the external flue for the extraction of fumes from the CHP boiler shall be submitted to and approved by the Local Planning Authority and all works which form part of the approved scheme shall be carried out and completed before the development is brought into use.
15. Notwithstanding the details submitted with the application no development shall be commenced until a scheme of measures to be implemented to minimise noise and vibration from the site at all times during the construction period has been submitted to and approved in writing by the Local Planning Authority. The scheme shall show how Best Practical Means shall be employed to minimise the impacts and special consideration should be given to Part 1, Section 10 of BS5228: 1997 Noise and Vibration on Construction Site”. The agreed scheme shall be implemented in full.
16. Notwithstanding the details submitted with the application no development shall be commenced until a scheme of measures to be implemented to minimise dust emissions from the site at all times during the construction period has been submitted to and approved in writing by the Local Planning Authority. The scheme shall show how Best Practicable Means shall be employed to control and monitor dust emissions. The agreed scheme shall be implemented in full.
17. The construction of the buildings hereby permitted shall not be carried out except during the following hours:
- Monday to Friday 07:30 to 18:00
- Saturday 08:00 to 13:00
unless prior agreement has been given to alternative hours by the Local Planning Authority.
18. Before the development hereby approved is brought into use a scheme of sound insulation for all plant and machinery shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall show how the plant and equipment will be enclosed with sound insulating material to achieve a rating level not exceeding the following level measured at the nearest noise sensitive premise:
nighttime L90 + 0 dB(A).
The approved scheme shall be implemented in full for each element of plant and machinery before that plant and machinery is brought into use.
19. Before the installation of the boiler plant is commenced, an air quality assessment shall be carried out to determine the air quality impact of the boiler plant. The scope and methodology used for this assessment should be agreed in writing with the Local Planning Authority and the final assessment report shall be submitted to and approved in writing by the Local Planning Authority. The boiler plant shall only be installed in accordance with the agreed scheme.
20. Notwithstanding the details submitted with the application no development shall be commenced until details of the arrangements to mitigate the air quality impact have been submitted to and approved in writing by the Local Planning Authority. The approved arrangements shall be fully implemented before the uses hereby permitted are first occupied.
21. Notwithstanding the details submitted with the application no development shall be commenced until an investigation and assessment of the nature and extent of any contamination of the site has been submitted to and approved in writing by the Local Planning Authority. The assessment shall identify any remedial measures required to deal with any hazards identified and such measures shall be implemented before the occupation of any of the buildings hereby permitted.
22. Notwithstanding the details submitted with the application before any part of the demolition of Municipal Buildings is commenced, particulars of the chimney removal and reconstruction (including how the chimneys will be dismantled, stored and relocated) shall be submitted to and approved in writing by the Local Planning Authority. The development shall be constructed only in accordance with the approved details.
23. Notwithstanding the details submitted with the application before any part of the demolitions of Municipal Buildings is commenced, particulars of the Façade retention and support details including the means of fixing and attachment of the interior frame to the listed façade shall be submitted to and approved in writing by the Local Planning Authority. The development shall be constructed only in accordance with the approved materials.
24. Notwithstanding the details submitted with the application no demolition of Municipal Buildings shall be commenced until particulars of the reinstatement of the Dome (including the design, materials and any proposed lighting scheme) to the corner of Library Street and Hewlett Street shall be submitted to and approved in writing by the Local Planning Authority. The development shall be constructed only in accordance with the approved materials.
25. Notwithstanding the details submitted with the application within 12 months of the commencement of development full details of the location, design, materials, colour and specification for the provision of street furniture (to include bins, bollards, benches etc) within the site shall be submitted to and approved in writing by the Local Planning Authority. Such approved facilities shall be fully provided before the first use of the buildings hereby approved commences and thereafter retained.
26. Notwithstanding the details submitted with the application within 12 months of the commencement of development full details of the location and specification for the provision of Public Art and the timing of its implementation within the site shall be submitted to and approved in writing by the Local Planning Authority. Such approved structures shall be provided in accordance with the agreed details.
27. Notwithstanding the details submitted with the application within 12 months of the commencement of the development details of a strategy for signage across the site (to include details of the size, location, design and material of signs) shall be submitted to and approved in writing by the Local Planning Authority. The approved details shall be implemented in full before first occupation.
28. Notwithstanding the details submitted with the application within 12 months of the commencement of the development a scheme of external lighting for the site shall be submitted to and approved in writing by the Local Planning Authority. The agreed scheme shall be implemented in full before first occupation.
29. Notwithstanding the details submitted with the application no development shall be commenced until details of the method of surface water and foul water drainage from the site have been submitted to and approved in writing by the Local Planning Authority and shall be installed in accordance with the approved details as an integral part of the development. No occupation or use of any building hereby approved shall commence until it has been connected to the approved drainage system.
30. The development shall be carried out in accordance with the mitigation measures contained in the report by The Tyrer Partnership Bird and Bat and submitted with the application.

2 Before any part of the development hereby approved is commenced on the northern and southern sites, and notwithstanding any previously submitted details, particulars/samples of the materials to be used for the external walls, roofs and entrances for each respective building shall be submitted to and approved in writing by the Local Planning Authority. The development of each building shall be constructed only in accordance with the approved materials.
3. The site shall be treated in accordance with a landscape scheme to be submitted to and approved in writing by the Local Planning Authority before any part of the development is commenced and all works in accordance with the scheme shall be completed within a period of 36 months from the date on which development in accordance with the permission hereby granted is first commenced, or such longer period as may be agreed by the Local Planning Authority, having regard to planting seasons, such landscape scheme to include; the planting of live trees, the treatment of the piazzas, the Wiend, pavements, the steps between Millgate and the piazza, and boundaries. All planting shall be maintained for a period of 5 years from the agreed date of planting.
4. Before any part of the development is commenced on the northern and southern sites, particulars of the rainscreen construction in relation to the panel size and joint details for each respective building shall be submitted to and approved in writing by the Local Planning Authority. The development of each building shall be carried out only in accordance with the approved details.
5. No works shall take place to Municipal Buildings until English Heritage and/or other nominated person(s) have been allowed to make a photographic record of Municipal Buildings. This must be carried out by a professionally qualified archaeological/building recording consultant or organisation in accordance with a written scheme of investigation which shall first have been submitted to and agreed in writing by the Local Planning Authority. Upon completion the photographic record of the building shall be submitted to the Local Planning Authority.
6. Notwithstanding the details submitted with the application no development shall be commenced until details of the proposed shared surfaces to include materials, colour and means of construction shall be submitted to and approved in writing by the Local Planning Authority. The development shall be constructed only in accordance with the approved materials unless alternatives are agreed.
7. Notwithstanding the details submitted with the application no development shall be commenced until the following information has been submitted to and approved in writing by the Local Planning Authority: (i) a full site survey showing:
- the datum used to calibrate the site levels
- levels along all site boundaries
- levels across the site at regular intervals
- floor levels of adjoining buildings
(ii) full details of the proposed finished floor levels of all buildings and hard surfaces, including showing how levels relate to land adjoining the site and how provision is to be made to all access for all users.
The development shall be carried out only in accordance with the approved details.
8. Notwithstanding the details submitted with the application before any part of the demolition of Municipal Buildings is commenced, particulars of the chimney removal and reconstruction (including how the chimneys will be dismantled, stored and relocated) shall be submitted to and approved in writing by the Local Planning Authority. The development shall be constructed only in accordance with the approved details.
9. Notwithstanding the details submitted with the application before any part of the demolitions of Municipal Buildings is commenced, particulars of the Façade retention and support details including the means of fixing and attachment of the interior frame to the listed façade shall be submitted to and approved in writing by the Local Planning Authority. The development shall be constructed only in accordance with the approved materials.
10. Notwithstanding the details submitted with the application no demolition of Municipal Buildings shall be commenced until particulars of the reinstatement of the Dome (including the design, materials and any proposed lighting scheme) to the corner of Library Street and Hewlett Street shall be submitted to and approved in writing by the Local Planning Authority. The development shall be constructed only in accordance with the approved materials.
11. No demolition of Municipal Buildings should be undertaken until details for the removal of the main staircase within Municipal Buildings (including identification of the elements to be retained, a programme for the removal of the main staircase and details of the subsequent retention and storage of the relevant parts) have been submitted to and agreed in writing by the Local Planning Authority. The works of demolition shall be carried out fully in accordance with the approved details.
12. Before any part of the demolition of Municipal Buildings hereby approved is commenced, particulars for the maintenance of the terracotta façade to the Municipal Buildings through a conservation management plan shall be submitted to and approved in writing by the Local Planning Authority. The development shall be undertaken and maintained only in accordance with the approved details.
13. The demolition works to Municipal Buildings shall not be commenced until a contract has been let for the works to implement the replacement building has been entered into.
