4 Application for a variation to a premises licence – Prince of Wales, Woodhouse Lane, Wigan: The Licensing Sub-Committee considered an application for a variation to a premises licence – Prince of Wales, Woodhouse Lane, Wigan.
The Licensing Officer’s report set out details of the application.
The applicant submitted the application to the Sub-Committee and answered questions.
Two interested parties submitted their case to the Sub-Committee and answered questions. Written representations and a petition signed by 17 residents had also been received.
In coming to its decision, the Sub-Committee took account of the Secretary of State's Guidance issued under the Licensing Act 2003 and the Council's own Licensing Policy.
Resolved: The Sub-Committee grants the application subject to the following additional conditions:-
- a tamper proof CCTV system shall be installed at the premises in liaison with and to the satisfaction of the Greater Manchester Police Local Crime Reduction Officer and shall be used to record during all hours that a licensable activity takes place on the premises;
- a written record shall be kept every time images are recorded by CCTV and shall include details of the recording medium used, the time and date recording commenced and finished. This record shall identify the person responsible for the recording and shall be signed by him/her. Where the recording is on a removable medium, a secure storage system to store those recording mediums shall be provided;
- the images recorded by the CCTV system shall be retained in unedited form for a period of not less than 31;
- all external doors and windows shall be kept closed when regulated entertainment is being provided except in the event of an emergency;
- the licence holder or his representative shall conduct regular assessment of noise coming from the premises on every occasion the premises are used for regulated entertainment and shall take steps to reduce the noise level where it is likely to cause disturbance to local residents. A written record shall be made of those assessments in a log book kept for the purpose and shall include, the time and date of the checks, the person making them and the results including any remedial action;
- there shall be placed at all exits from the premises in a place where they can be seen and easily read by the public notices requiring customers to leave the premises and the area quietly; and
- the Committee suggests that the applicant employs a noise limiter. If unacceptable levels of noise persist, Environmental Services will be requested to monitor the issue.
5 Application for a variation of a premises licence – Bar Aqua, 1 – 3 Gerard Street, Ashton-in-Makerfield, Wigan: The Licensing Sub-Committee considered an application for a variation to a premises licence – Bar Aqua, 1 – 3 Gerard Street, Ashton-in-Makerfield, Wigan.
The Licensing Officer’s report set out details of the application.
The applicant submitted the application to the Sub-Committee and answered questions.
Written representations had been received from three members of the public. The applicant was of the view that the representations had been made by people who did not live in the vicinity of the premises. The Sub Committee considered the matter and were of the same view. In these circumstances the members of the public could not be regarded as interested parties and their representations were not taken into account.
