116 Minutes: The minutes of the meeting of the Cabinet held on 26 July 2007 were approved as a correct record.

117 Exclusion of the public - section 100a Local Government Act 1972: Resolved: The public is excluded from the meeting when the Cabinet discusses the following items for the reasons set out below:-

118 Policing public events: The Chairman agreed to this additional item being taken as urgent, the special circumstance being the need to agree a response.

The Executive Leader reported that, following several incidents across Greater Manchester, the Greater Manchester Police Authority had decided to produce a force-wide policy for these situations and that the authorities in Greater Manchester would be asked for their views.

There were no alternative options available for consideration.

Resolved: The Cabinet delegates power to the Director of Environmental Services, following consultation with the Executive Leader, the Deputy Leader, the Cabinet Champions for Neighbourhood and Equality and Councillor C Rigby (Greater Manchester Police Authority spokesperson), to submit a response to the consultation.

119 Visit to Angers: The Chairman agreed to this additional item being taken as urgent, the special circumstance being the need to respond to the invitation.

The Executive Leader reported that he had received an invitation for a delegation from the Council to visit Angers in September 2007.

There were no alternative options available for consideration.

Resolved: The Cabinet appoints the Executive Leader, the Mayor (Councillor J D O’Brien) and the Cabinet Champion for Children and Young People together with the Chief Executive and the Deputy Director of Children and Young People’s Services as delegates to Angers and authorises the Chief Executive to make all necessary arrangements.

120 Wigan South Central (Minute XXX refers): The Cabinet considered a report on the progress being made on development within Wigan South Central, which covered the former Pemberton Colliery, Westwood Park and Wigan Pier Quarter, plus the southern parts of Wigan Town Centre and public transport interchanges.

The report set out details of the alternative options to be considered. The reason for selecting the one recommended was to ensure the further regeneration opportunities within Wigan South Central and to establish priorities for action within Wigan South Central for the next 15 years.

Resolved: The Cabinet:-

  • notes the submission of an application to Manchester Enterprise (acting as agent for the North West Development Agency) in the sum of £100,000 to fund a master planning exercise on this project; and
  • delegates authority to the Director of Environmental Services, in consultation with the Cabinet Champion for Regeneration, to appoint consultants to establish a strategic masterplan for Wigan South Central.

121 Anti racism pledge: The Cabinet considered a report on the anti-racism pledge, prepared by Wigan and Leigh United Against Racism (WLUAR), which was intended to promote a positive image for the borough as a tolerant and open community and so provide reassurance to the minority community who lived, worked and studied here.

The report set out details of the alternative options to be considered. The reason for selecting the one recommended was to actively demonstrate a public sector/voluntary sector alliance on anti-racism.

Resolved: The Cabinet recommends the Council to adopt the pledge as part of the policy framework.

122 School Admissions Appeals Panel Members: The Cabinet considered a report on applications received from people wishing to act as Panel Members.

The report set out details of the alternative options to be considered. The reason for selecting the one recommended was to ensure that the Council had a pool of properly appointed Panel Members from which to draw individual Appeals Panels.

Resolved: The Cabinet:-

  • appoints the persons identified in appendix 1 to the report as Lay Members for Admission Appeals Panels in accordance with the Education (Admissions Appeals Arrangements) (England) Regulations 2002; and
  • appoints the persons identified in appendix 2 to the report as Non Lay Members for Admission Appeals Panels in accordance with the Education (Admissions Appeals Arrangements) (England) Regulations 2002.

123 Grant of Drainage Rights to Gladedale (NW) Ltd on land adjacent 134 Astley Street, Tyldesley: The Cabinet considered a report on terms provisionally negotiated for the granting of drainage rights across land in the Council’s ownership to facilitate a residential development on adjoining land.

The report set out details of the alternative options to be considered. The reason for selecting the one recommended was to maximise the level of compensation for granting the easement.

Councillor B M Wilson reported that the Greater Manchester Archaeological Unit had discovered the remains of the Gin Pit Colliery on the residential development site and were in discussions with the developers on the best way to preserve them because of their unique nature. The Unit had suggested that the Council could use some of the capital receipt generated by this land disposal to contribute towards the cost of preservation.

Resolved: The Cabinet:-

  • grants foul and surface drainage rights through Council owned land adjoining 134 Astley Street, Tyldesley to Gladedale (NW) Limited (in connection with their Ley Road development) on the terms and conditions set out in the report; and
  • authorises the Director of Legal and Property Services to enter into negotiations with the Greater Manchester Archaeological Unit on their proposal now referred to and to report thereon to a future meeting.
