Private hire vehicle – test failure

2. Private hire vehicle – test failure: The Sub Committee considered a report which advised Members of a currently licensed private hire vehicle failing its six monthly test. A notice of suspension had been issued in respect of the vehicle licence.

Item 1.2 on the report stated that because of the condition of the vehicle, no road test was carried out. This was altered at the meeting as the vehicle had undergone a road test.

The Committee interviewed the proprietor of the vehicle.

The proprietor withdrew from the meeting while the Sub-Committee considered its decision.

Resolved: The Sub Committee agrees to lift the suspension of the vehicle providing that it reaches the standards of fitness required by the Council

The Sub-Committee also suggests that it would be beneficial if the proprietor adopted a regular and through maintenance schedule.

To Hear an appeal against an unresolved grievance submitted by a former employee of the Finance and Information Technology Department

2. To Hear an appeal against an unresolved grievance submitted by a former employee of the Finance and Information Technology Department: The Head of Personnel informed the Committee that a former employee of the Finance and Information Technology Department had submitted a grievance appeal in relation to an unresolved issue about outstanding employee pension contributions.

Management and the Appellant had submitted written evidence to support their case.

The Appellant and his representative, together with representatives of Management then entered the meeting. Each side presented their case to the Committee had the opportunity to ask and respond to questions.

Both sides withdrew from the meeting while the Committee considered its decision.

Resolved: The appeal is dismissed.

2. Application for the grant of a private hire vehicle licence: The Sub Committee considered a report which advised Members of an application for the grant of a private hire vehicle licence.

The Applicant attended the hearing and answered questions.

The proprietor withdrew from the meeting while the Sub Committee considered its decision.

Resolved: The Sub Committee refuses to grant the application on the ground that it is not satisfied that the vehicle is in a suitable mechanical condition and is safe to be licensed as a private hire vehicle.

2. Private hire vehicle licence suspension : The Sub Committee considered a report which advised Members of the suspension of a licensed private hire vehicle following the failure of a six month test.

The proprietor attended the hearing and answered questions.

The Sub Committee viewed the vehicle.

The proprietor withdrew from the meeting while the Sub Committee considered its decision.

Resolved: The Sub Committee will allow the vehicle proprietor to carry out repairs to the vehicle and to have the vehicle re inspected and if it meets the Council’s fitness standards, the suspension will be lifted.

6. Application for the grant of a licence to drive private hire vehicle: The Committee considered a report which advised Members of an application for a licence to drive private hire vehicles.

The applicant attended the hearing and answered questions.

Resolved: This Committee grants the application but issues a severe warning to the driver regarding his future conduct.

7. Application for the grant of a licence to drive private hire vehicle: The Committee considered a report which advised Members of an application for a licence to drive private hire vehicles.

The applicant attended the hearing and answered questions.

Resolved: This Committee refuses to grant the application on the grounds that the applicant is not a fit and proper person to hold a private hire driver’s licence.
