A trader who enters into a contract with a consumer (whether written or verbal) in the consumer's home, place of work, the home of another individual, or an excursion organised by the trader - away from the trader's business premises - is likely to be affected if the goods offered or services provided exceed £35.
The trader must give the consumer a right to cancel a contract to which the Regulations apply by:
- giving the consumer a cooling-off period of at least seven calender days in which to exercise the right to cancel the contract starting from the date of receipt of the "notice of right to cancel",
- the trader must give the consumer a written notice of his right to cancel the contract, and
- the notice must contain the information as set out in the Regulations and a cancellation form provided as a detachable slip for use by the consumer, if he wishes to cancel the contract.
